Privacy & Confidentiality Statement
CA Nelson Corp./Online Real Estate Assistant and all of their related companies
and subsidiaries wish to affirm their mutual commitments made at the time of
this Agreement to protect the confidential information of each client.
CA Nelson Corp./Online Real Estate does not and will not sell to any company its
database of agents, buyers, seller, and vendors. We appreciate your cooperation
by NOT asking.
All information communicated, orally or in writing, to CA Nelson Corp./Online
Real Estate Assistant by Client or by CA Nelson Corp./Online Real Estate
Assistant in connection with or containing any Proprietary Materials
(“Confidential Information”), shall be used only for purposes of, and in
accordance with the services provided, and no such Confidential Information
shall be disclosed by either party, other agents, employees, or subcontractors,
without the prior written consent of the other party, except as may be necessary
by reason of legal, accounting or regulatory requirements through court order.
We appreciate your cooperation by NOT asking.
Except to the extent otherwise required applicable law or professional
standards, the parties’ obligations under this section do not apply to
information that:
1.
Is
or becomes generally available to the public through no fault of, or omission or
action by, the receiving party.
2.
Can
be shown by documentation to have been known to, or possessed by, the receiving
party prior to disclosure by the disclosing party.
3.
Is
used as a part of a marketing package such as brochures, flyers or post cards.
4.
Is
independently created by CA Nelson Corp./Online Real Estate Assistant.
5.
Is
a template created by CA Nelson Corp./Online Real Estate Assistant for the
purpose of providing options for all clients.
6.
Is
known to be general in nature as it relates to the industry and is commonly used
by other real estate professionals.
Each party shall be deemed to have met its obligations under this agreement as
long as it exercises the same level of care to protect the other’s information
as it exercises to protect its own confidential information, which in no event
shall be less than a level of reasonable care, except to the extent that
applicable law or professional standards impose a higher requirement.
We appreciate your cooperation by NOT asking.
Each party agrees that any and all knowledge or information that may be obtained
in the course of the contract service with respect to the conduct and details of
the business and with respect to the processes, formulas, marketing,
advertising, policies, etc used by CA Nelson Corp./Online Real Estate Assistant
and Client will be forever held inviolate and be concealed from any competitor.
